These terms and conditions govern your use of our website and services & products. Please read the terms in full before you use any of them. If you do not accept these terms, please do not use our services and products. Using them implies that you accept these terms. We update these terms regularly so please refer back to them in the future.

Online Training
Payment Terms
The course fee must be paid prior to receiving course materials. Payment can be made by PayPal or credit card. Once materials have been accessed and downloaded, your course fee cannot be refunded, however, if you are not fully satisfied with the course content, please contact us within 48 hours of your first access for a full refund.
We reserve the right to cancel or terminate a course or to refuse any enrolment as permitted by law.

General
The course materials are designed for individual student use. They are the intellectual property of THNK.innovation and they cannot be copied, distributed or reproduced in any way except with the written permission of THNK.innovation, or unless clearly stated within the course materials. Downloaded videos are to be used only by the registered member, they are not to be transferred/shared amongst other people.

Website Uptime
We take all reasonable steps to ensure that THNK.innovation is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and, other technical issues. Therefore, we will not be liable if this THNK.innovation website is unavailable at any time. This site may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control. Where possible we will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so.

Contact
By registering for an online course, you are consenting for THNK.innovation to send you information pertaining to your course, such as course details, reminders and support information. During the course access period, emails will generally be sent on a weekly basis. Following your completion of the course, we may send you other information very occasionally about other courses we think you might be interested in. You can unsubscribe from this at any time. Please see our Privacy Policy for more details on how we collect and treat your personal information.

Your THNK.innovation Account

  1. THNK.innovation retains the right to exclude access to online courses at its discretion.
  2. Your course access may be transferred to another party under certain conditions.
  3. You must use all reasonable efforts to keep your username and password confidential.
  4. You must not allow any third party to access the content using your username and password and make use of the content on your behalf.
  5. You must notify THNK.innovation in writing as soon as you become aware of any unauthorised use of your THNK.innovation username or password.
  6. You acknowledge and agree that you are liable for, and will indemnify THNK.innovation, its related bodies corporate, affiliates, officers, directors, agents and employees against, any and all claims made by a third party arising out of your access to, and use of, the THNK.innovation site content.

Guarantee
Because we are certain of the quality of our courses, we give you a 100% satisfaction guarantee. Should you however not be happy for any reason with the quality of our training, just ask for your money back within 3 days of enrolling in a course (or purchasing a product).

Disclaimer
The information contained in our online courses is provided on the understanding that it neither represents nor is intended to be advice and that neither the publisher nor author is engaged in rendering legal or professional advice. The intent is to offer you, the student, a variety of information to provide you with a wider range of choices both now and in the future, recognising that we all have widely diverse circumstances and viewpoints. While all attempts have been made to verify information provided, neither the author nor the publisher nor the marketing agents assume any responsibility for errors, omissions or contrary interpretation of the subject matter under any condition or circumstances. Certification
A certificate of attendance will be awarded on completion of the course. Courses are not offered as vocational training and will not qualify you for any specific employment. Course credits are not transferable to any accredited educational institution.

In-house Workshops
Cancellation Policy

  1. To confirm your workshop a 20% deposit of the total amount is required within 2 weeks of receipt of the proposal
  2. Full pre-payment (less any deposit received) is required 4 weeks prior to your workshop
  3. Payments are non-transferrable. A tax invoice will be sent to you with payment details once you have confirmed the workshop. Payment can be made by bank transfer, PayPal or credit card.
  4. If you wish to reschedule or cancel the workshop, and notify us:
    * 8 weeks prior to the event or earlier, no penalty will apply and your deposit refunded
    * 4 to 8 weeks prior to the event, your deposit will not be refunded
    * 2 to 4 weeks prior to the event, 20% of your fee will be refunded
    * less than 2 weeks prior to the workshop, no fees will be refunded
    * A workshop cancellation request must be made in writing (email) to info@THNKinn.com.au
  5. Should THNK.innovation due to unforeseeable events be required to reschedule a workshop, we will attempt to set a mutually agreed reschedule date. If this is not possible, we will fully refund the pre-payments already made.

Substitutions
Substitutions can be made, with prior notification in writing to THNK.innovation, at any time up to the workshop or event start date, with no penalty. Please contact us as soon as possible with the name of your substitute attendee so that we can arrange a certificate in their name.

Non-Attendance
If a delegate fails to attend a course, even in the case of illness, program fees will not be refunded or allocated to another course.

Travel Allowance

  • N/A for workshop deliveries in Melbourne CBD and inner suburbs*
  • Outer Melbourne suburbs*: mileage reimbursement+
  • Regional Victoria: Flights and/or mileage, accommodation and other applicable incidental reimbursement+
  • Interstate: Flights, accommodation and other applicable incidental reimbursement+
    * Within a radius of 25km around Melbourne CBD
    + Based on current ATO guidelines

Copyright
THNK.innovation’s course material is protected by copyright. The material must not be copied or utilised in any way other than for personal education purposes of the original delegate.

Coaching & Mentoring
Payment Terms
The coaching fee must be paid monthly in advance. A tax invoice will be sent to you with payment details once you have signed the coaching agreement. Payment can be made by bank transfer, PayPal or credit card.

Procedure
Coaching sessions are conducted either:

  1. Online, via Skype or other online platform (client to call the coach)
  2. Phone (client to call the coach)
  3. Face-to-face, Melbourne Western Suburbs or less than 15km from Melbourne CBD* (client to organise appropriate venue)
    * Additional cost for face-to-face coaching outside of the indicated area may apply

Coaching
The client is aware that coaching is in no way to be construed as psychological counselling or any type of therapy. Coaching results are not guaranteed. The client enters into the coaching with the full understanding that they are responsible for creating their own results.
Should the client be under the care of a mental health practitioner and/or taking mental health medication, s/he understands that s/he is responsible to make the coach aware of this situation and provide a written referral immediately.

THNK.innovation recognises that anything the client shares is regarded as confidential, whether it is business or personal information. We undertake not to, at any time, either directly or indirectly use or disclose any information the client shares with us in a session. However, there are some situations in which the Coach is legally obliged to report information (e.g. when having serious concerns about the client’s safety, or the safety of someone else).

Cancellation Policy

  1. Please notify us in writing (email) to info@THNKinn.com.au at least 24 hours in advance if you wish to reschedule a session, or the session will be charged as if attended.
  2. No-shows will be charged as if attended.
  3. Sessions begin and end at the scheduled times. Sessions starting late due to the client arriving late, end at the appointed time and are considered to be delivered in full.
  4. We understand that sometimes an emergency situation may arise when an advanced notice is not possible. In this instance, please contact us on 1300 936 313 as soon as you are able. These situations will be dealt with on a case-to-case basis.
  5. Should THNK.innovation due to unforeseeable events be required to reschedule a session, we will contact the client as soon as possible to set a mutually agreed reschedule date.

Terms Of Use

  1. Disclaimer and limitation of liability.
    The output from the Services is believed to be accurate and current. However, THNK.innovation does not give any representation or warranty as to the reliability or completeness of the output. Nor does THNK.innovation warrant that any of the functions contained in the output of the services will be error-free.
    b. THNK.innovation shall not be liable in any way for any loss or damage, howsoever arising (whether in negligence or otherwise) out of or in connection with the provision of the Services except where liability is made non-excludable by legislation.
    c. Making decisions based on any information presented in our products, events, services, or web site, should be done only with the knowledge that you could experience risk or losses just like any entrepreneurial endeavour. Use caution and always consult your accountant, lawyer or professional advisor before acting on this or any information related to a lifestyle change or your business or finances. You alone are responsible and accountable for your decisions, actions and results in life, and by your registration here you agree not to attempt to hold us liable for your decisions, actions or results, at any time, under any circumstance.
    d. The user must indemnify and hold harmless THNK.innovation and keep it indemnified, against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from:
    i. any breach by the user of the General Term and Conditions; or
    ii reliance by the user on any information arising from the use of resources or video tutorials as part of the Service
  2. Governing Jurisdiction. This Legal Notice shall be governed by and construed in accordance with Australian law. Any dispute(s) arising in connection with this Legal Notice are subject to the exclusive jurisdiction of Australia.
  3. Website access and Use. You will be able to access the majority of this Website without having to register any details with us. However, particular areas of this Website will only be accessible if you have registered. You are permitted to use our website for your own purposes and to print and download material from this Website provided that you do not modify any content without our consent. Material on this website must not be republished online or offline without our permission. The copyright and other intellectual property rights in all material on this Website are owned by us or our licensors and must not be reproduced without our prior consent. No part of this Website may be reproduced without our prior written permission. For further information about data collection, please refer to our Privacy Policy and Cookie Policy.
  4. Delivery of product. All reasonable effort is made by THNK.innovation to deliver your order to you. All orders are confirmed by THNK.innovation at time of placement. THNK.innovation takes no responsibility for orders that have been denied, lost or incorrectly made. Any disputes are to be sent via email to info@THNKinn.com.au with a detailed description of dispute.
  5. THNK.innovation is a sole trader with the ABN 23 525 149 534, and is not registered for GST.
  6. Payments must be made monthly in advance by credit card if subscribing to a paid service. Monthly fees will be deducted automatically each month on the anniversary date of joining.

Below is our confidentiality agreement. In effect, by signing up with THNK.innovation you have our assurance that your personal or company information will remain your property and will remain confidential.

  1. Confidentiality Agreement

THNK.innovation acknowledges that during the provision of support it may have access to and become acquainted with various trade secrets, inventions, innovations, processes, information, records and specifications owned or licensed by the User and/or used by the User in connection with the operation of its business including, without limitation, the User’s business and product processes, methods, customer lists, accounts and procedures. THNK.innovation agrees that it will not disclose any of the aforesaid, directly or indirectly, or use any of them in any manner, either during the term of this Agreement or at any time thereafter, except as required in the course of this support with the User, unless otherwise authorised by the User in writing.  All files, records, documents, blueprints, specifications, information, letters, notes, media lists, original artwork/creative, notebooks, and similar items relating to the business of the User shall remain the exclusive property of the User. THNK.innovation further agrees that it shall at all times preserve the confidential nature of its relationship to the Client and of the services hereunder. THNK.innovation further acknowledges that the information provided THNK.innovation by the User is the confidential information of the User and THNK.innovation further agrees not to disclose that information other than to authorised representatives of THNK.innovation and that THNK.innovation also agrees to be bound by the provisions of this clause and to maintain the integrity and confidentiality of the User’s information Other staff engaged by THNK.innovation shall be bound by the foregoing duties with respect to User confidentiality.
